Acceptance of Terms
These Terms & Conditions govern your use of cad4land.com and any CAD drafting services provided by CAD4LAND. By submitting a quote request, signing an engagement letter, creating a Client Portal account or otherwise engaging us, you agree to these terms.
Project-specific terms in a signed engagement letter or master services agreement take precedence over these general terms in the event of any conflict.
Scope of Services
CAD4LAND provides outsourced CAD drafting and production support across three disciplines — Land Development Design Drafting, Land Based Engineering, and Land Survey CAD Drafting — and the sub-services listed on the Services pages.
We do not certify, seal or stamp any drawing. All deliverables are produced under the direction of, and for review by, a licensed professional surveyor or engineer of record retained by the client. The client is solely responsible for the professional review, sealing, recordation and legal sufficiency of all final drawings.
Project Intake and Standards
Clients are expected to provide:
- Field notes, raw survey data, point clouds, deeds, easements, plats, control sheets and any other source material reasonably required to perform the work.
- Office CAD standards including title block, layer naming, line types, text styles, plot styles and sheet sizes — or written authorization to use CAD4LAND's default standards.
- A point of contact authorized to approve scope, redlines and revisions.
We will draft to the standards you provide. Re-drafting required because final standards were issued mid-project is billable as a revision.
Revisions
Each quoted sheet includes a reasonable number of revision rounds based on redlines from the client's licensed reviewer. Additional revision rounds, scope changes or material rework caused by changes in source data are billable at our then-current revision rate, which will be disclosed before work begins.
Fees, Invoicing and Payment
Fees are quoted per sheet, per project or on a retainer basis as set out in the engagement letter. Unless otherwise agreed in writing, invoices are due net fifteen (15) days from the invoice date. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum allowed by law.
We reserve the right to suspend work or withhold final, plot-ready deliverables on accounts with overdue balances.
Ownership of Work Product
Upon receipt of full payment for an engagement, the resulting CAD drawings and deliverables produced for that engagement become the property of the client.
CAD4LAND retains ownership of its internal templates, scripts, blocks, dynamic blocks, LISP routines, drafting macros, standards libraries and general know-how. Nothing in any engagement transfers these underlying tools to the client.
We may reference engagements in our portfolio in a generic, de-identified form (e.g., 'a 14-lot residential plat in the southeastern U.S.') unless the engagement letter prohibits it.
Confidentiality
We treat all client materials — field data, drawings, deeds, plats, project narratives — as confidential by default. We will not disclose project information to third parties except as required to perform the work or as compelled by law. See the Privacy Policy for additional detail on data handling.
Disclaimers and Limitation of Liability
Drafting services are provided on a professional, best-efforts basis. CAD4LAND is not the surveyor or engineer of record. The client's licensed professional is responsible for:
- Verifying that source data, control, monumentation and computations are correct.
- Reviewing, signing, sealing and accepting final drawings.
- All recordation, permitting and code-compliance decisions.
To the maximum extent permitted by law, CAD4LAND's total aggregate liability arising out of any engagement is limited to the fees actually paid by the client for the specific deliverable giving rise to the claim. We are not liable for indirect, incidental, consequential or lost-profit damages.
Use of the Website
You agree not to misuse cad4land.com — including attempting to access non-public areas, interfering with the Client Portal, scraping at scale, or uploading malicious content. We may suspend or terminate access for misuse.
Termination
Either party may terminate an engagement on written notice. The client will be invoiced for all work performed up to the effective termination date. Sections of these Terms that by their nature should survive termination — including ownership, confidentiality, payment of accrued fees and limitation of liability — will survive.
Governing Law
These Terms are governed by the laws of the jurisdiction in which CAD4LAND is established, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction unless the engagement letter specifies binding arbitration.
Changes to These Terms
We may update these Terms from time to time. Updates take effect when posted on this page. Continued use of the website or our services after updates are posted constitutes acceptance of the revised Terms.
